Terms of service.

Payments
Payment is due on the day of service/upon receipt of invoice unless otherwise noted
within the Invoice or Proposal. Credit Card payments are subject to a processing fee of
3.5% (Subject to change). We do not accept check via mail, however ACH payment
methods are available upon request. Payments not received in full on the day of service
are subject to a late fee and or Interest. Unpaid invoices after 30 days are subject to
collections which include, but are not limited to, Property Lien, Theft of Services filed at
the Local Police Department, Civil Court and reporting to all national collection
agencies. Any discounts are subject to be voided due to non payment or outstanding
balances. Upon execution of the Invoice or Proposal the Owner will provide payment as
provided in the Invoice or Proposal. The Owner shall pay all invoices, including change
orders, within the time frame outlined in the Invoice or Proposal. Work will be scheduled
upon receipt of deposit as outlined in Proposal. If Owner has secured institutional
financing for the Work, Owner shall request the institution to issue payments for the
Work as either one party checks, made payable to APC, or two-party checks, payable to
Owner and APC. Any sums due after 30 days will incur interest charges of 24 percent
per annum, compounded monthly. All Work performed by APC shall be completed in a
workmanlike manner according to standard practices, and under applicable municipal
and State codes. If your check is returned for non-sufficient funds, you expressly
authorize your account to be electronically debited or bank drafted for the amount of the
check plus any applicable fees. The use of a check for payment is your
acknowledgment and acceptance of this policy and its terms and conditions. We
reserve the right to withhold any future work or warranty work including labor and
materials at any point if payment is not made without penalty. Any labor or materials
costs that are denied coverage from a manufacturer, vendor, insurance or warranty
company is the responsibility of the Owner and required to be paid in full upon
notification of the denial.
Warranty
All work described on Invoice or Proposal, with the exception of drain cleaning, has a
one year warranty on workmanship unless noted on contract. APC supplied fixtures or
materials have a manufacturer’s warranty. The consumer is responsible for submitting
manufacturer’s warranty registrations. Warranty is void if a balance remains unpaid. Not
responsible for customer supplied materials. APC is not responsible for existing
conditions or water quality.
APC cannot offer any warranty or guarantee on certain services including clearing
clogged drain lines or customer supplied parts.STANDARD 1-YEAR WARRANTY LIMITATIONS AND RESTRICTIONS
1. Toilet repair and installation.
Warranty void if in-tank cleaners have been used or pressure exceeds 80 psi.
Warranty valid only when a ball valve style stop is present at toilet.
Warranty does not cover future repairs due to uneven floors, tile or grout popping, broken
flange, deteriorated wax ring or a rocking / moving toilet.
2. New fixtures
Warranty does not protect against foreign objects entering garbage disposal or clogging of any
kind.
Warranty void when pressure exceeds 80 psi.
Warranty not applicable on fixtures we do not furnish.
Warranty not applicable on non-standard repairs or as documented on service invoice.
Warranty does not apply to pressure reducing valves (PRV) which are installed outside and
underground.
3. Sewage Ejectors and Sump Pumps
Warranty does not protect against clogging or foreign materials entering the sewage pits or
sump pumps.
Warranty does not cover damage due to electrical surge or non-power.
4. Circulation pumps and electric water heaters
Warranty void if evidence of power failure has caused overheating and burn out to pump or
element of water heater.
Warranty void if water has been turned off to house and evidence is cause of burn out.
Warranty void if air is in the line or pressure has exceeded 80 psi.
Warranty void if check valves on the circulation side are not functioning.
5. Drain replacement or drain-pipe cleaning
Warranty does not protect against any clogging of the drainage system or fixtures installed.
Though we will make every effort to properly resolve drain-pipe problems, including sewer
cleaning, camera investigation and as necessary pipe replacement, we do not warranty against
future back up issues. Any further work required to be done in the evident of a subsequent
drain problem or vent issue will incur additional charges.
LIMITATIONS & RESTRICTIONS TO ANY 1-YEAR OR 3-YEAR WARRANTY
• Warranty void if pressure exceeding 80 psi is present in the plumbing distribution system.
• Warranty does not protect against freeze breaks or freeze related problems. Homeowner shall
take all reasonable care to allow faucets to drip when sub-freezing temperatures are occurring.
• Warranty does not protect against any clogging of the drainage system or fixtures installed.
• Warranty does not cover any connections made to existing plumbing which are not up to code
or require the use of a Sharkbite® fitting or such fittings are present in the existing system.
• Warranty does not cover any connections made to water filters nor adapters connecting from
filter to our piping.• Warranty covers repair and replacement only to newly installed components or new associated
piping.
• Warranty excludes water remediation, drying, damages to structures or real property or
personal belongings, water backup damage or treatment to surfaces affected by water damage.
• Warranty excludes connections made to existing systems, appurtenances, fixtures, appliances
and equipment and all homeowner supplied fixtures or parts.
• Warranty excludes piping or fitting damage resulting from any hot water recirculation system
which is in either a state of continuous use, does not have the appropriate rated pump
regarding gallons per minute and the load is higher than is rated by the manufacturer,
circulation line is not sized according to the manufacturers recommendations, temperature is
set above 140F or pressure above 80 psi, thermal expansion tank is not properly charged, or
installation of such line does not comply with manufacturers statements.
WARRANTY DOES NOT COVER CONNECTIONS MADE TO THE FOLLOWING:
• Polybutylene® (Poly B) Pipe or any other piping in a class action lawsuit or pending litigation
• Nibco®, Viega® or Vanguard Pex® pipe
• Galvanized Pipe
• Lead Pipe
• Type M copper installed underground (or any copper pipe on a well system)
• Cast Iron Pipe
• Existing PVC and CPVC pipe and associated mechanical fittings
3 OWNER’S PRELIMINARY REQUIREMENTS
Unless otherwise agreed, prior to APC commencing Work the Owner shall, at their sole
cost and expense: complete engineering, survey, or other plans fort the project; obtain
any federal, state, and municipal approvals or permits required for APC to perform the
contemplated Work; provide a work site capable of supporting and permitting APC’s
Work to occur without any additional, ancillary or incidental steps by APC not explicitly
identified in the Invoice or Proposal; clear the project site prior to construction of any
debris, equipment, personal items and/or construction materials that would materially
interfere with APC’s performance of the Work. Owner’s failure to meet the conditions
identified above, on or before the date identified above, for any reason other than APC’s
negligence, shall constitute breach of this agreement and result in damages as provided
in the Damages section.
Damages
DAMAGES. Owner agrees that the only damages that may be brought by Owner
against APC relate to APC’s failure to complete the contracted work, or damage to the
Owner’s property or persons while on owners’ property. Owner agrees that any breach
of this Contract shall result in damages to APC, including all direct and incidental
damages arising from the breach. Owner agrees that APC’s damages shall include, but
not be limited to: APC’s time, resources, equipment and overhead used in mobilization,
purchasing materials, and preparing plans, APC’s loss of reasonably anticipated profitson this project or other projects occasioned by Owner’s breach or termination of this
agreement, APC’s losses arising from delays during the prosecution of this Proposal
awaiting Owner’s receipt of any plans, approvals, or permits for APC to complete the
Work not arising from APC’s negligence; and APC’s reasonable attorneys’ fees and
costs associated with any legal action as a result of Owner’s breach, including any claim for mechanic’s lien.
